Letter to the Editor: Supreme Court shouldn’t be persecuted for ruling on constitutional principles

OPINION — In response to the Letter to the Editor that was published in St. George News from M. Taylor, “We won’t go back, and we won’t back down from abortion fight,” it was, to say the least, not factual or objective and was highly inflammatory.

In the opening statement, Taylor states, “A Supreme Court stacked with partisan justices stolen by corrupt politicians has overturned Roe with their recent ruling on Dobbs v. Jackson Women’s Health and gutted the federal protection of abortion rights and control over our own bodies. I’m here to say that we won’t go back and we won’t back down.”

The assertion that the Supreme Court is stacked with partisan justices stolen by corrupt politicians is dangerous, particularly where justices have been stalked and harassed in their homes and elsewhere. This is illegal, but has been allowed without any repercussions from law enforcement. Justice Brett Kavanaugh was even the subject of an assassination attempt.

Do we want a society where judges have to fear for their lives and go into hiding when they render decisions someone doesn’t approve of, particularly where there have been recent instances where federal judges have been murdered after decisions someone didn’t agree with?

Is it being suggested liberal justices don’t have any partisan leanings in their decisions? This is dangerous rhetoric that has been recklessly allowed to thrive in the media and puts our judiciary and system in danger.

The idea the Supreme Court returned the decision to the states is the very definition of a Representative Republic, which is what we have in America. Leaving decisions in the hands of communities who elect representative to enact laws is what our governing system is all about.

It is fine for the author to encourage others to vote for those who will best represent their views, but it’s not okay to attack and distort what the Supreme Court did when it was what they are supposed to do. They followed constitutional principles of returning power to states to enact laws and were not acting in an openly partisan or corrupt manner.

Even Ruth Bader Ginsburg, who was in favor of abortion rights, was of the opinion Roe v. Wade was not decided on constitutional grounds. This court followed constitutional principles instead of the judiciary creating laws or rights not outlined in the constitution.

The media allowing these kinds of attacks on the justices and sometimes seemingly perpetuating this type of discourse, is dangerous and only creates an environment of division and distrust.
