HILDALE – Francisco Sergio Chareca, 26, of Hildale, who was arrested Sunday for unlawful sexual conduct with a 17-year-old girl, received additional charges Tuesday for unlawful sexual activity with a 15-year-old girl.
Late Monday evening, police were notified of a possible sexual assault case involving Chareca and a 15-year-old girl, Hildale Police Sgt. Samuel Johnson said in a probable cause statement supporting the additional charges against Chareca.
The 15-year-old girl told police she had been at a party when Chareca approached her and told her they needed to talk, according to the statement. The man and girl then allegedly walked away from the party and had a sexual encounter.
The mother took the girl to the Children’s Justice Center in St. George for an interview with one of the forensic interviewers, where the girl disclosed the details of what allegedly happened.
The girl said the incident occurred when the two were at a party in January out by Apple Valley, the statement said. The girl said when the two of them were away from the others at the party to talk, Chareca took their clothes off and the two engaged in oral sex and sexual intercourse.
After they got dressed, the girl and another person rode back to Hildale with Chareca.
After Chareca dropped off the passenger, he allegedly got in the back seat with the girl and took his clothes off, according to the statement. When Chareca began to undo the girl’s jeans, the girl pushed him away and told him to “stop” and then got out of the car and walked home.
In addition to this incident, police responded to a Hildale residence Sunday, where the father of a 17-year-old girl reported that Chareca had sexual intercourse with his daughter.
After interviewing the girl, police learned she and Chareca had sexual intercourse “a couple times,” according to a statement of probable cause, and they had sent multiple nude photos to each other via cellphone and Facebook.
Chareca was arrested and booked into the Washington County Purgatory Correctional Facility Sunday on four second-degree felony charges of sexual exploitation of a minor and three third-degree felonies for unlawful sexual conduct with a 16- or 17-year-old.
On Tuesday, Chareca was additionally charged with a third-degree felony for unlawful sexual activity with a minor and a class A misdemeanor for attempted unlawful sexual activity with a minor.
Judge G. Michael Westfall, of the 5th District Court, ordered Chareca’s bail amount set at $5,000 during his initial court appearance Tuesday for the first reported incident and then an additional $1,950 Wednesday for the additional charges.
Chareca is scheduled to make his next court appearance Monday, where he will be represented by court-appointed attorney Douglas Terry.
Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
