Man allegedly harasses Winger’s patrons, found stumbling in road, arrested for drugs

CEDAR CITY — A Cedar City man was arrested on Monday for possession of heroin and other drugs following an incident at the Winger’s Roadhouse Grill, located at 1555 Regency Road in Cedar City.

Officers responded to the restaurant at approximately 6:30 p.m. on a report of a man harassing patrons in the restaurant, Cedar City Police Officer Clint Pollock wrote in a probable cause statement supporting the arrest. As officers were responding, the man had left the area, heading southbound on foot.

There were also reports that the man was looking in the back of pickup trucks as he was leaving, Cedar City Police Sgt. Jimmy Roden said. The citizens who witnessed it reported that it appeared suspicious.

Pollock located the man, later identified as 53-year-old Kevin Holmes, stumbling in the roadway, the statement said. While speaking with Holmes, Pollock said he appeared to be intoxicated.

“As Kevin spoke, his speech was slurred, he had bloodshot eyes and the strong odor of an alcoholic beverage,” Pollock said in the statement.

When Pollock asked Holmes if he could conduct a search of his person, Holmes agreed, the statement said. During the search, the officer found multiple drugs and drug paraphernalia.

“I felt a syringe in his front right shirt pocket that he admitted was used for heroin,” Pollock said in the statement. “In the syringe, there was blood.”

During the search, the officer also found multiple syringes inside the lining of Holmes’ coat, the statement said, which appeared to have been used. Pollock also discovered a ball of heroin in Holmes’ pocket and a single pill identified as alprazolam, a schedule IV controlled substance used to treat anxiety and panic disorders, Pollock said in the statement. Holmes did not have a prescription for the medication.

Holmes was arrested without incident and booked into the Iron County Jail. He was charged with one third-degree felony for possession of heroin; two class B misdemeanors for possession of alprazolam and drug paraphernalia; and a class C misdemeanor for public intoxication.

Holmes bail for release pending trial is set at $5,000 cash only.

Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.

    Very sad. Obviously has serious mental health issues. WAY into self medication for the pain.

      ROBB yeah there are some serious issues for this guy. But he’s better off in custody for his own protection and of course the community doesn’t need him running around loose. so all in all him getting arrested was the best thing for him and the locals

    I hear coming down off of heroin makes you very sick, so I hope they have proper medical care to help him detox. Or he is gonna bail out and get his next fix so he doesn’t have to go through withdrawals. They guys picture looks like he’s dying. Very bad drug! Kids, stay away from heroin!
